Texas Dram Shop Law

According to the Texas Dram Shop Act of 1987, if a person was “obviously intoxicated to the extent that he presented a clear danger to himself and others” and was still served alcohol, the person serving them can be held responsible for the intoxicated person’s later actions. Typically this act covers places such as restaurants, bars, taverns and pubs.

However, under the Supreme Court case F.F.P. Operating Partners vs. Duenez, the law was changed. Before this case, dram shops could be held 100 percent liable for damages. During this case, though, the court decided that a dram shop may only be held responsible if they can be considered to be 51% or more responsible for the drunk person’s actions. If they are determined to be more than half responsible for their actions, the dram shop will only be liable for the percentage of damages for which they are considered responsible.
